Notice of Updated Terms & Conditions
The following terms and conditions constitute part of the contract between you and Njem Limited (subsequently referred to as "Njem", "We" or the "Company"). You are deemed to have read, and consented to, these terms and conditions by engaging the services of Njem Limited or its subsidiaries.
Unless otherwise stated, the terms and conditions below apply for all customers who have engaged the services of the Company pertaining to their travel needs, unless otherwise stated.
ELIGIBILITY
- You must be at least 18 years old or have parental consent to use the Platform.
- By using the Platform, you confirm that you have the legal capacity to enter into these Terms.
ACCOUNT REGISTRATION
- You must provide accurate information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- We reserve the right to suspend or terminate accounts that violate these Terms.
USER CONDUCT
By using the Platform, you agree not to:
- Use the Platform for fraudulent, illegal, or abusive purposes.
- Post or share false, misleading, or inappropriate content.
- Violate the rights of other users, including privacy and intellectual property rights.
RESERVATIONS AND PAYMENTS
All Payments must be made through the Payment gateways provided by the company or via bank transfers into accounts bearing the Company's name [Input account name here]. Other than this means stipulated for payment by the Company, the Company accepts no responsibility for payment made by any third party on behalf of the Company without the Company's express instruction. The failure to remit payments on a timely basis will automatically put your booking at risk of cancellation. Additionally, the Company is held harmless for any cancellation of any booking on account of either late payment or declination of a credit card or cheque.
Failure to make payments by the specified deadlines may result in cancellation of the booking without refund.
All bookings come on a first come first served basis and are only secured when the payment for the service has been paid. It is your responsibility to ensure you pay for your desired service. We urge that you review all aspects of your booking to verify vital information, including but not limited to: your contact details, itineraries, and other relevant information. Please notify the Company immediately if you notice any omissions and/or corrections are needed regarding the booking details. You assume full & sole responsibility for any risks and/or costs involved with failure or delay to report such errors and/or omissions.
While we continually work towards a seamless service, Payment does not automatically constitute a booking until such payment is confirmed. We urge you to reach out to us through any of our designated channels [support@gonjem.com, @go.njem (IG), etc] when confirmation is unduly delayed. Our confirmations are done within a working day of payment. Failure to comply with this may result in automatic cancellation of the reservation and forfeiture of Payment.
All prices are per person and include accommodations, transportation, select meals, and planned activities. Prices do not include airfare, personal expenses, travel insurance, or optional excursions unless explicitly stated.
Prices quoted by the Company are based on the information available to the Company at the time of quoting. Accordingly, such prices and availability are not guaranteed until payment is completed.
While the Company is always working to ensure your payment process is seamless, the Company is not responsible for variations or fluctuations in pricing, as the Company simply reflects the pricing of the original vendors.
CANCELLATIONS
All cancelled reservations are required to be expressly communicated to the Company through the designated channels gonjem.com/support. However, cancellation fees will apply, and it is computed based on the length of the notice period given prior to the departure. The cancellation fees, as well as corresponding refund components, are subject to company calculation.
All cancellations will be subject to penalties imposed by the vendors and suppliers we source our products and services from and according to their terms and conditions.
We advise you to check their terms and conditions for more information. As such, to recoup the costs caused by a customer's cancellation, they may demand cancellation fees through us.
While the Company always works to bring you a good experience, the Company is acting as an agent for services rendered. As such, all arrangements are still subject to final confirmation, even where payments have been made. Regardless, the Company will promptly notify you when there is a need for any cancellation. The Company reserves the right to cancel any pre-confirmed booking on this basis, or on any other basis. The Company may, if it so chooses, recommend alternative reservations or airlines either to the same destination or to other destinations, based on our current travel and reservation payments.
Where the Company is unable to recommend similar bookings in the same price range, the Company may recommend more or less expensive alternatives. In the case of the former, the customer may be made to pay the difference. In the case of the latter, there would be refunded the difference.
Note that the Company shall not be held liable for any cancellation where such cancellation is caused by third-party issues not within the control of the Company including airline cancellations, accommodation owner non-availability, hospital or hotel non-disposition not resulting from the Company and the Company shall not be liable for any claims, losses, damages or costs arising therefrom.
REFUNDS
Where a customer fails to utilize any of our services made available to them (e.g., accommodation, reservations, or any other bookings) either in part or in full, no refunds shall be offered.
Where the Company cancels a customer's booking, the Company will refund the customer's payments. Refunds shall be computed based on the original amount paid by the customer. Refunds will be paid to you within seven(7) to ten(10) business days. Where these refunds may take longer, the same will be communicated to the customer.
Refunds are estimated to be completed within this duration, as the Company acts as an agent for hotels, hospitals, accommodation owners, airlines, and other facilities, and it may take some time to recover expenses paid.
Refunds would be made to the customer's Account. It is the duty of the customer to verify the accuracy of the details provided.
TRAVEL INSURANCE
The Company does not take out travel insurance on behalf of its customers. We, however, recommend travel insurance coverage for potential difficulties like trip cancellation, loss of deposit, etc.
The Company will not be liable or deemed a carrier under a contract of carriage of a passenger and of his/her baggage and other personal belongings. The Company's staff will be pleased to assist you in making enquiries relating to travel insurance.
RESPONSIBILITY
- Because flight timings are dictated by airlines, and the customer getting to the airport, railway or other transportational boarding point on time largely depends on transportation used, weather conditions and other factors out of our control, the customer bears the responsibility of getting themselves to the airport within the scheduled time and check in on time. Please note that the failure of the means of transport to depart at the scheduled time would not cause the Company to incur any liability.
- In the event of a dispute between a transportation company and a customer, The Company may intervene to ensure a resolution of the issue between the customer and the transportation company. However, such intervention by the Company does not make it liable for any loss.
- It is the customer's responsibility to adhere to the vehicles conditions, such as; maximum luggage load, child seating, carry-ons, etc. Note that the Company will take these conditions into consideration when providing its service to you, and communicate the same with you at the point of booking.
- It is the customer's responsibility to ensure that they have all relevant travel documents prior to departure and return. We recommend that you pay attention to visa application periods in your country and prepare with the usual periods in mind. We also advise that you anticipate delays from your embassies/ consulates in your application periods and start application processes earlier than you ordinarily would. The Company will not be responsible for any expenses or refund any payments for services not used where the Customer is prevented from enjoying these services on account of incomplete or faulty travel documentation.
- Once a ticket has been purchased and issued by the transportation company, the travel policy shall be governed by the transportation company. These tickets are generally non-transferable, except that the transport company agrees otherwise. Additionally, any modifications to the ticket are at the discretion of the transportation company.
- Unscheduled stopovers would be treated in line with the policy of the transportation company.
- Travelers acknowledge that participation in this journey involves inherent risks, including but not limited to transportation delays, illness, accidents, and loss of personal belongings.
- Njem is not responsible for any personal injuries, property damage, or losses incurred during the Journey.
- Travelers assume full responsibility for their well-being and agree to adhere to safety guidelines provided by Njem and local authorities.
- The Company will not bear any responsibility or pay compensation for any delays caused by any force majeure. Force Majeure refers to any situation that reasonably prohibits the Company or supplier of any service from being able to provide its service. These include war, political situations, extreme weather conditions, pandemics, or any other element that makes it impossible or unreasonable for the Company or service provider to serve.
- The Company is simply an intermediary between the customer and the suppliers of the services that constitute the customer's travel package. The Company shall not bear any liability for any act or omission of these service providers. While the Company may, at its discretion, intervene in such issues to ensure a swift resolution of the issue, such intervention shall not be construed as an intention to bear any liability.
- The Company shall bear no responsibility for any monies paid to these suppliers, any accidents or ANY OTHER FORM OF LIABILITY. This does not preclude the customer from taking any legal action against these service providers.
- Additionally, refunds by transportation companies shall be borne by those companies alone. Granted, the Company MAY assist in presenting a refund request to the relevant airline or hotel for assessment. Should a refund be authorized, such refund will be made to you, less any cancellation or administrative charges.
CHANGES AND GROUP ARRANGEMENTS
While we would do our best to ensure your modifications are effected, all changes remain subject to the conditions of the service supplier's policy. Where we are able to make these changes, you may be required to pay additional charges imposed by the supplier as administrative costs.
A sole customer who is part of a group package may only make such change in so far as it would not affect the entire package, or the other members of the package consent to such change. To the extent that they consent, additional costs for the modification would be borne by the entire group. Regardless, the Company shall not be held liable for failure/inability to make changes that are not within its control.
Note, however, that such change may be made where the person demanding the change is willing to bear the surplus cost. This should not deter you from contacting the Company if you have any concerns for your personal safety or the safety of your property due to the actions or behaviour of your group.
MINORS AND INFANTS
Generally, minors and infants must use our services through a parent or guardian. Certain packages may come with their own minor/infant policies and stipulate which services minors and infants may use. These are generally based on the laws of the destination country, the policies of the suppliers or at our discretion. Please note that we do not intend to deprive the young ones of any experience and any restriction in this regard is their interest. Be rest assured that these would be communicated to you at the point of booking.
Unaccompanied minors are to inform us before booking to ensure our approval before booking, and to allow arrangements to be made with the relevant transport company.
We reserve the right to refuse to serve an unaccompanied minor where we believe it is in their best interest that we do so.
COMPLAINTS
All Complaints during travel must be made to the Company through email at gonjem.com/support. for the Company's investigation. The Company claims no responsibility for complaints not made.
Additionally, the resolution of a complaint may not always result in a refund or payment to a customer. It is the Company's duty to investigate such complaints and seek to resolve them in the first instance.
MODIFICATION
The terms and conditions may be amended or modified by the Company at any time without notice. The terms and conditions may have changed since the last time an order was placed by you. It is therefore your responsibility to familiarize yourself with the terms and conditions to know what is applicable before making every booking, particularly to ensure what provisions are in operation in case they have changed since the last time an order was placed by you.
SEVERABILITY
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any other parts.
CONTENT AND INTELLECTUAL PROPERTY
User-Generated Content
- Users may upload photos, videos, and reviews to the platform.
- By uploading content, you grant Njem a non-exclusive, royalty-free license to use, modify, and distribute it within the Platform.
Intellectual Property Rights
- All Platform content, including trademarks, logos, and software, is owned or licensed by Njem.
- Unauthorized use of our intellectual property is prohibited.
PRIVACY AND DATA PROTECTION
We collect and use personal information in accordance with our privacy policy, which can be found at: /privacy. Users are responsible for securing their own data and account access.
HEADINGS
Headings in this document are for references only and do not limit their content to the title of the heading.
GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in all respects by Nigerian law and shall be subject to the jurisdiction of Nigerian courts.
ACCEPTANCE
By purchasing any of our packages, you agree that you have read and consent to these terms and conditions.
